Terms of Service

These Terms of Service (“Terms”) govern your use of the Vyum mobile app and related services (the “Service”) operated by Tetiana Novytska (“Vyum”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use Vyum. By using the Service you confirm that you meet this requirement.

2. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate information when registering, and notify us promptly of any unauthorized use. You can delete your account at any time from Profile → Delete account in the app.

3. License to use

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial recipe management. You may not copy, resell, or commercially exploit the Service except as expressly permitted.

4. AI features — important

Vyum uses artificial intelligence to scan and structure recipes, suggest ingredient substitutions, translate recipes, and provide a voice cooking assistant. AI output can be incomplete, inaccurate, or wrong.

5. Your content

You retain ownership of the recipes and other content you add to Vyum. You grant us a limited license to store, process, and display that content solely to operate the Service for you (including sending it to our AI provider to perform actions you request). You are responsible for ensuring you have the right to upload and use any content you import, and for not infringing the rights of others.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to bypass usage limits, rate limits, or access controls, or abuse the AI features (e.g. automated or excessive requests).
• Reverse-engineer, decompile, or attempt to extract source code or API keys from the app.
• Interfere with or disrupt the Service or its infrastructure.

7. Price and AI usage limits

• Vyum is free. There is no subscription, no in-app purchase, and nothing to pay. We do not ask for payment details.
• Donations are optional. If you want to support the app, you may send a voluntary tip through Buy Me a Coffee — available only on our website, never inside the mobile app. A donation is a gift, not a purchase: it buys no product, unlocks no feature, raises no usage limit, and entitles you to nothing. Donations are handled on Buy Me a Coffee’s site under their terms, and are non-refundable.
• Daily AI allowance. AI-powered actions (recipe scanning, import, ingredient substitutions, translation, and the voice assistant) are limited to a set number per day for each account. When you reach the limit, the AI features pause until the allowance resets; the rest of the app keeps working. The limit also sits under a monthly ceiling.
• These limits can change. AI processing costs us money per request, so we may adjust the allowance, or add or remove AI features, to keep the Service sustainable. We are not obliged to provide any particular amount of AI usage.
• Fair use. The allowance is for normal personal use. We apply reasonable technical safeguards (such as rate limits) against automated, scripted, shared-account, or otherwise excessive usage that no individual cook would reach in ordinary use. These safeguards do not affect typical personal use.

8. Third-party services

The Service relies on third-party providers (including Supabase, Anthropic, Unsplash, Resend, Buy Me a Coffee, and the app stores). Your use of the Service is also subject to their applicable terms, and we are not responsible for their services.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate.

10. Limitation of liability

To the maximum extent permitted by law, Vyum will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) CAD $50. Vyum is free, and donations are gifts rather than payment for the Service, so in practice this means CAD $50.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could harm us, other users, or third parties.

12. Changes to these Terms

We may update these Terms from time to time. We will revise the “Last updated” date above and, for material changes, provide additional notice where appropriate. Continued use of the Service after changes take effect means you accept the updated Terms.
